This User Agreement (hereinafter - the Agreement) is concluded between Nobelbee (hereinafter referred to as the Agreement - the Agent) and a capable individual (hereinafter - the User).
The agreement to enter into this agreement (acceptance of the offer) is to register or authorize in the Mobile application Nobelbee App and pay for the acquired right to receive the service. This Agreement is considered concluded (enters into force) from the moment that occurs earlier: completion of the User registration procedure in the Nobelbee App Mobile Application or authorization by the User in the Nobelbee App Mobile Application.
"Nobelbee App" is a service of congratulating users by money transfers between them, which is the intellectual property of the Agent. Nobelbee App in the context of this Agreement is a computer program that includes a mobile application for mobile operating systems IOS and Android and a related remote platform for the formation and accounting of money transfers through public application programming interfaces (API) payment systems.
Sender - a registered user of the Nobelbee App, with his own Visa / Mastercard payment card authorized in the application, which sends funds to the Recipient.
Recipient - a registered user of the Nobelbee App, with his own Visa / Mastercard payment card authorized in the application, who receives funds from the Sender.
Money transfer - transfer of funds from the Sender's card to the Recipient's card using payment systems.
Chip In service - greeting by money transfer of a fixed amount. Transfer processing is carried out by integration through the API of payment systems.
“Send Gift” service - greeting by money transfer of the amount independently indicated (determined) by the Sender. Transfer processing is carried out by integration through the API of payment systems.
"User" means a person who uses the Nobelbee App.
"Agent" means the Nobelbee App Owner who manages the Nobelbee App Mobile Application.
"Payment system" - a person (enterprise, institution, organization, etc.) that implements a payment processing service initiated through the Nobelbee App.
"Commission" - the cost (price) of the service, which is indicated in the "Info" section.
"Payment document" - an information message containing complete information about the transaction. The payment document is sent to the user's e-mail specified in the "Profile" section.
"Authorization in the Nobelbee App" - the user enters credentials (phone, name, date of birth, etc.) that allow access to the Nobelbee App.
"User's e-mail address" (e-mail) - the user's e-mail address specified when registering in the Nobelbee App. The Nobelbee App sends a Payment Document and other messages to the user's email address.
2.1. Pursuant to this Agreement, the Agent grants the User the non-exclusive right to use the Nobelbee App in any way and in any form within its declared functionality at any time and under the conditions set forth in this Agreement, except for the time of preventive and other work. , as well as other circumstances that prevent the User from accessing the mobile application Nobelbee App.
2.2. The Agent is not the actual executor of Money Transfers and regulates exclusively the procedure for using the Nobelbee App mobile application for using the “Send Money”, “Chip In” and “Send Gift” services and the procedure for paying for selected services.
2.3. Processing of Money Transfers, which is carried out using the services “Send Money”, “Chip In” and “Send Gift”, is carried out by payment systems on the basis of an agreement concluded between the Payment System and the Agent.
2.4. An individual who has not reached the age of majority has the right to use this mobile application only if the consent to this Agreement is given by his parents or his legal representatives. The responsibility for violation by a minor user of this Agreement or current legislation when using the mobile application is borne by his parents or legal representatives.
2.5. The user is aware that the mobile application Nobelbee App is provided to him "AS IS" ("AS IS"), due to problems arising in the process of updating, maintaining and operating the User of the mobile application (including: compatibility issues with other software products (applications, drivers, etc.), problems that arise due to ambiguous interpretation of reference information, inconsistency of the functionality of the mobile application with the expectations of the User, etc.), the Agent is not responsible. The Agent does not give the User any guarantee that he will benefit or benefit from the use of the mobile application.
3.1. To use the mobile application or some of its individual functions, the User must go through the registration procedure, as a result of which a unique account (Account) will be created for the User and access to the mobile application will be granted.
3.2. To register, the User undertakes to accurately and completely fill in the information about himself on the issues offered in the Registration Form, and to keep this information up to date. The user is responsible for the completeness and accuracy of the information provided during registration (e-mail address, mobile phone number). If the User indicates inaccurate / incomplete information, the Agent is not responsible for failure to provide fiscal electronic documents (in particular, Payment Documents) and possible refusal to provide services.
3.3. The User confirms and guarantees that all actions provided for him by this Agreement are performed by a person whose data is sent to the Agent during the registration procedure.
3.4. The user has the right to register no more than one account.
3.5. The user is solely responsible for all actions (as well as their consequences) in the use of the mobile application Nobelbee App under his credentials. All actions within or using the Nobelbee App mobile application under the User's Account are considered to have been made by the User. The User is solely responsible for any actions and operations of persons to whom the User has transferred the data used to Authorize and / or register the User in the Nobelbee App.
3.6. The Agent is not responsible for the selection of the User's password by third parties and any actions performed by them using the selected password.
3.7. The User is obliged to immediately notify the Agent of any case of unauthorized (unauthorized) access to the mobile application Nobelbee App and / or of any violation (suspected violation) of the confidentiality of his account.
3.8. The Agent has the right to send advertising and informational messages to the User. If the User does not wish to receive such messages, he may request the cancellation of information through his e-mail service.
4.1. The Agent undertakes to make every effort to prevent failures, but is not responsible for temporary technical failures and interruptions in the mobile application Nobelbee App, regardless of the causes of such failures and their duration.
4.2. The Agent has the right to terminate access to the Nobelbee App, if this is due, in particular, to the inability to use information and transport channels and other equipment that is not the Agent's own resources or actions or inaction of third parties, if it directly affects the provision of services Agreement, including in case of emergency. In this case, the Agent is not liable to the User and does not reimburse losses due to delays, interruptions and inability to use the resources and services of the mobile application.
4.3. As the mobile application Nobelbee App is at the stage of constant addition and updating of features, the name and composition of the provided functions may change from time to time without prior notice of the User, the Agent has the right to terminate (temporarily or permanently) any individual functions. mobile application without prior notice to the User.
4.4. The agent undertakes to regularly improve the hardware and software complex, but does not guarantee that the software of the mobile application does not contain errors, the hardware will not go out of operation and will function smoothly.
4.5. The Agent is not liable for damages or other damage caused to the User in connection with his unqualified actions, as well as the actions of third parties.
5.1. The User undertakes to read the current version of the Agreement each time he visits the Nobelbee App mobile application and to adhere to its provisions.
5.2. The User is obliged to ensure the confidentiality of their data, the disclosure of which may lead to negative consequences for the User. The user is solely responsible for all risks and losses in this regard.
5.3. The user is obliged to indicate in the "Profile" section his real date of birth.
6.1. To purchase the service, the User must consistently perform the following actions:
a) Log in to the Nobelbee App mobile app under your own name or log in.
b) Select the user who will receive the greeting.
c) Select the icon that corresponds to the selected service and click it. Click on the active welcome button.
d) Pay for the service with a bank card. To make bank card payments, the User is automatically redirected to the secure page of the bank of the payment card issuer.
The user can save his bank card data in the payment system to simplify payments. To link a bank card, the User must fill in all the fields on the "Profile" page. In this case, the Agent does not store or process payment data of the User.
6.2. Based on the results of the successful payment, the User will receive a Payment Document to the e-mail address specified during registration.
The Agent is not responsible for the actions of payment systems through which the User makes Money Transfers, including errors in the operation of payment system data, as well as the processing of data entered by the User.
6.3. After successful payment for the Nobelbee App, the App creates a corresponding entry, which will be displayed in the User's profile.
7.1. Refund of Money Transfers is allowed only in the cases provided by this Agreement and the current legislation of Ukraine.
7.2. The User of the Nobelbee App has the right to demand from the Agent to return the amount of the Money Transfer made by the User in case the “Send Money”, “Send Gift” or “Chip In” service was purchased by the User accidentally or by mistake. In the event of such a case, the User must send an e-mail from his e-mail registered in the Nobelbee App to the e-mail address "support@Nobelbee.com" within 24 hours from the moment of making the Money Transfer, which he considers accidental or erroneous (Subject of the letter: "Return funds ”) together with the Payment Receipt Nobelbee App, which was sent to the e-mail of the User at the time of the relevant Money Transfer.
The agent checks the transaction information within two working days from the date of receipt of such request, agrees on the possibility of returning the Money Transfer with the relevant payment system and notifies the Nobelbee App Owner of the result.
7.3. If it is possible to refund the amount of the Money Transfer made by the User, which he considers accidental or erroneous, such refund is made in accordance with the rules of the payment system. In case of refusal of the payment system to make such a refund, the User undertakes to resolve the issue of the refund directly with the Recipient of the relevant Money Transfer, which the User considers accidental or erroneous.
8.1. When registering in the Mobile Application, the User provides the Agent with the following personal data:
o e-mail address,
o phone number.
The purpose of the processing of personal data is to fulfill the obligations and provide the services provided for in this Agreement.
8.2. Having concluded this Agreement, in order to comply with the requirements of the legislation of Ukraine on personal data protection, the User grants the Agent permission (unambiguous and unconditional consent) to transfer, process, store his personal data (surname, name and patronymic, e-mail, mobile phone number, etc.) , which became known to the Agent as a result of the User's interaction with the Nobelbee App, in any way, in particular, but not exclusively, by collecting, recording, processing, storing, systematizing, accumulating, adapting, using, including by including in the database data of the Agent, transfer to third parties within their competence (provision, access), distribution, blocking, deletion. The User grants permission (unambiguous and unconditional consent) to the Agent to disseminate personal data in cases directly provided by law and only at the request of the authorized body to obtain such information or when the need to disseminate data in certain forms and amounts directly from Ukrainian law. The User who has entered into this Agreement agrees to the Agent to use his personal data specified in the Agreement in order to comply with the terms of this Agreement, compliance with Ukrainian legislation, accounting, preparation of documents and for other purposes related to this Agreement.
The processing of personal data must be carried out by the Agent in accordance with the requirements of the legislation on personal data protection. The above consent to the processing of personal data of the User is indefinite and does not depend on the term of this Agreement.
The Agent has the right to transfer personal data to the payment system to fulfill the terms of this Agreement, if the need for this follows from the essence of the Agreement and the operation of the Nobelbee App.
8.3. The User is responsible for the accuracy of the provided personal data.
8.4. Processing of personal data specified in clause 8.1. means recording, systematization, accumulation, storage, clarification (update, change), use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
8.5. Processing and storage of personal data of the User is carried out by the Agent
8.6. The user may at any time revoke consent to the processing of personal data, in accordance with Part 11 of Art. 8 of the Law of Ukraine "On Personal Data Protection", sending a message to the Agent to the e-mail address: support@Nobelbee.com. In this case, all information received from the User is deleted from the Nobelbee App, and the User will not have access to the Nobelbee App.
8.7. In the event of a change in personal data, the user is obliged to provide as soon as possible updated, reliable information to update the Agent of his personal data. All negative consequences of failure to provide such information are borne by the User.
8.8. Completion by the User of the registration or Authorization procedure in the mobile application is a conscious consent to the processing of his personal data in accordance with this Agreement, in addition, by concluding the Agreement the User confirms that he is familiar with the Law of Ukraine "On Personal Data Protection".
9.1. The Agent shall not be liable for any damage caused to the Nobelbee App Owner as a result of improper performance of its obligations by the payment system.
9.2. In case of questions about the quality of service, the User is able to ask for help from the Agent by sending a written request to the email address of the support service specified in the "Info" section of the Nobelbee App. In this case, the Agent will try to assist in resolving the situation.
9.3. The Agent shall not be liable to the User and Owner of the Nobelbee App for any damages, damages, damages, lost data, damage to honor, dignity, religious feelings or business reputation arising in connection with the use of the Nobelbee App, content, materials, to which the User has accessed using the Nobelbee App.
9.4. The User undertakes to check Money Transfers in favor of Recipients for the need to withhold personal income tax in the manner prescribed by applicable law of Ukraine and be solely responsible for the withholding and payment of any applicable taxes and fees to be deducted from payments for in favor of Recipients to be carried out using the Nobelbee App.
9.5. The Agent may unilaterally amend this Agreement by posting the changes on the nobelbee.com website and / or in the Nobelbee App. The changes take effect from the moment of publication, unless another date of entry into force of the changes is specified in addition to their publication.
10.1. The pre-trial settlement procedure for disputes under this Agreement is mandatory.
10.2. Complaints The user sends to the support service in the mobile application Nobelbee App, located on the screen "Profile" or to the e-mail address: support@Nobelbee.com with the obligatory indication of the subject of the letter: "Complaint".
10.3. Submission of claims in a different way than specified in paragraph 10.2. this agreement is not allowed.
10.4. The term for consideration of the claim is 30 (thirty) working days from the date of receipt of the claim.
